Wedding Terms and Conditions

In the following terms & conditions “the photographer(s)” shall mean: Ian Petrie trading as Petrie's Photography & their employee's. 

“The client(s)” shall be those persons defined as making the booking.

These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.


By purchasing images in either print or digital format, you are purchasing the right to the image as governed by the package/licensing you purchased, not the copyright (ownership) of the image and therefore have no rights to reproduce the image in or on any medium (social media resolution by agreement) without the permission of the copy right holder in writing.

Any images or copies of images whether stored digitally or otherwise, and any computer program including any source or object code, computer files or printed documentation relating to such images is protected by the Copyright, Designs and Patents Act 1988 and are therefore the property of 'Petrie's Photography'. 

It is contrary to the Act to copy/alter or allow to be copied /altered - photographically/electronically or by any other means - an image created as part of your agreement with 'Petrie's Photography' without the permission of the copy right holder in writing. This is a standard condition for professional photographers and includes removal of watermark (if any), cropping, re-editing and/or electronic reproduction on social media sites.

Website Display & Promotional Usage

By Signing a Consent form, the client(s) hereby allow(s) the photographer(s) to display any photograph/image covered by the package agreement and to generally promote 'Petrie's Photography’ business in advertising, brochures, magazine articles, websites, sample albums etc.

(Additional permission will be sought from the client(s)if minors are included.) The photographer will aim to keep all photographs and images safe from any malicious activity but cannot be held liable or accountable for malicious actions carried out by persons other than 'Petrie's Photography employees.

Force Majeure

The photographer(s) will endeavour to put the client(s) in touch with another local photographer with similar style and packages in the event they are unable to attend on the booking date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of cancellation by the photographer(s), or in the very unlikely event of total photographic failure, liability shall be limited to a full refund.


These Terms and Conditions shall be governed in accordance with the current copyright and Intellectual property Laws of Great Britain (England, Wales, Scotland and N. Ireland).


The Photographer shall not be liable for indirect loss or third-party claims occasioned by delay in completing the work or for any loss to our customers arising from a delay in transit due to postal services. Where any images supplied are found to be defective/damaged for any reason, the photographer's liability (if any) shall be limited to rectifying such issues including replacement.

Any reasonable and accepted directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk and therefore the photographer cannot be held responsible for any subsequent personal accident(s) during said photographic shoot. Your statutory rights are not affected. 'Petrie's Photography has full public liability and Professional Indemnity insurance to £1 million pounds.


The Photographer shall be granted artistic licence in relation to the poses photographed, the location used and all post digital retouching. The Photographers’ judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.

When in attendance at a booking, 'Petrie's Photography' will endeavour to capture all specific images requested by the client(s) but will not be held liable for failure to do so if restricted by any venue official, or obstructed view or un-cooperative guests of said client, especially if the safety of either the photographer or client(s) and or other guests might be compromised by trying to do so.

Photographs and Images

All photograph and image sizes are nominal as per package and license purchased and will be supplied in professional matt finish for best framing purposes. All printed photographs supplied by 'Petrie's Photography' are produced to the highest standards using the best quality print laboratory materials and latest processing techniques. However, all photographs will, in time, fade. Especially if they are left in bright sunlight and are not behind glass. 'Petrie's Photography' cannot accept any responsibility for this gradual image deterioration. All pictures purchased are presumed to have been received in good condition unless the Client notifies 'Petrie's Photography' in writing of any quality issues within 14 days of receipt.

Booking Fee/Deposit

A non-refundable booking Fee/Deposit/Retainer of £195 unless otherwise agreed different (Dependent on Package and agreement) is charged when the client agrees the booking, this fee is deducted (in full) from the total price.

The booking Fee/Deposit/Retainer secures the time and services of the photographer for the booking, admin and general account management tasks needed to service a customer and is non-refundable or transferable in the event of cancellation -  subject to events covered above under force majeure.

Payment of the remaining balance (minus the booking Fee/Deposit/Retainer) is to be made in cleared funds via monthly instalment or in full no later than 28 working days prior to the date of the booking/event.

'Petrie's Photography' currently accepts payment using the following methods: Cash, Card via Sum-up or BACS transfer (account details available on request). Standard P&P is included with all Packages/license. Prices for All services and/or goods are supplied at the current site price quoted but are subject to change without prior notice. The photographer is not VAT registered so VAT is not quoted or charged.


All cancellations must be in writing. When a booking has been postponed (rather than cancelled) to a later date, the photographer(s) will retain any fee paid unless the photographer(s) can re-schedule for the new date and time. Where the photographer(s) is able to re-book then the cancellation fee will revert to the original booking fee.

If the client(s) cancel with over 9 months before the wedding date there will be a 35% of the booked package to be either paid or retain with immediate effect, If the client(s) cancel with over 5 months but less than 9 months before the wedding date there will be a 45% of the booked package to be either paid or retain with immediate effect. 

If the client(s) cancel with less than 3 months before the wedding date, there will be a 65% of the booked package inclusive of the booking fee/Deposit/Retainer to be either paid or retain with immediate effect. 

This is due to much of the work to service that booking would have already been done and cannot be refunded, it is also unlikely that the date can be covered with a similar package deal to cover that loss of earnings that could have been taken by another client(s). However, If the photographer(s) can refill the date the client(s) cancelled by another booking of equal value, 'Petrie's Photography' will offer a full refund minus the booking fee/deposit/retainer.

Refund Policy

The photographer(s) will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as 'Petrie's Photography' cannot be held responsible for individual tastes or expectations after proof images have been agreed.


The final output and finish of any image will be at the photographer’s discretion. All digital images (Proofed images, Final print and Digital negatives- RAW) will be retained for three months after completion and acceptance of final product, after which time the RAW images will be stored in a secure location (access to these images is solely limited to the photographer(s). ‘Petrie's Photography’ does not supply client(s) with any RAW file - Raw image files will be deleted after 2 years

Our Obligations

'Petrie's Photography' will always endeavour to supply the service requested as per your package/booking in a recognised professional and timely manner.


'Petrie's Photography' would request that all information required to carry out the service for which we have been booked is supplied as and when requested, and that any issues that might arise are notified to us as soon as possible so we can take the necessary action to continue to provide a quality service. It will be deemed that by booking the services of 'Petrie's Photography' that the client(s) are therefore happy and understanding of the basic T&C’s as outlined above.


Any complaints should first be raised by the client(s) with the photographer(s) in writing (In the first instance using the contact page) within 14 days from the date of receipt of images or issue arising. 'Petrie's Photography' reserves the right to amend these Terms and Conditions without prior notice and in line with any future legal requirement to do so.

Portrait Session Terms and Conditions

In the following terms & conditions “the photographer(s)” shall mean: Ian Petrie trading as Petrie's Photography & their employee's. 

“The client(s)” shall be those persons defined as making the booking.

These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.

1. Retainer Payment is due to confirm the scheduled session. Client agrees to pay session fee in full before date of scheduled session. The Client shall make a non-refundable retainer (aka session fee) to the Photographer to perform the services specified herein.

2. If the Client requests to reschedule a session, the retainer shall be applied to a rescheduled session if notice is given at least 14 days prior to the scheduled event. If the rescheduling request is due to a Client illness, less notice may be allowed. The Photographer or Client may request to reschedule the session due to weather; discussion about the possibility of rescheduling should begin 24 hours prior to the session with a final decision made no later than 1 hour prior to the session. Rescheduled sessions must occur within the same calendar year.

3. Late Arrivals. Any Client that is late arriving to a session will have the amount of time late deducted from the time allotted for the session. This may also result in a reduction of the number of edited images.

4. Cancellation. If the Client cancels a session without rescheduling or fails to show for a scheduled session, the retainer shall be forfeited.

5. Files. Petrie’s Photography will keep files from your session for 2 years. After this time, Petrie’s Photography will no longer be responsible for holding copies of your images, digital files or photographs.

6. The Photographer retains the right of discretion in selecting the photographic materials released to the client. The Photographer shall make edited images available through an on-line gallery proofing website or through an in-person ordering session.

7. Images shall be available to the Client in approximately 10 to 14 working days after the session. All downloaded must be fulfilled within 30 days of image gallery delivery. Photographer shall not be held responsible for delivery delays.

8. All photographic materials, including but not limited to unedited RAW files and edited JPGs, shall be the exclusive property of the Photographer. The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographers website, studio, etc. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client. It is understood that any duplication or alteration of original images is strictly prohibited without the written permission of the Photographer.

9. The Client shall only use the prints and products, including digital files, in accordance with the permissions within this agreement. The Clients prints are for personal use only and shall not be submitted to contests or reproduced for commercial use. The Client may not authorize any reproductions by parties other than the Photographer. If the Client purchases digital files, the Client must act in accordance with the digital file print release that accompanies them. Client may not edit images, add filters, or hire out another party to edit images.

10. The Client may share blog post links and Facebook albums through use of the share functions and dissemination of direct links. Client shall not screen shot, add filters or edits, or capture the photographs in any other fashion.

11. If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited to return of all deposits made.

12. The Photographer shall be held harmless for all injury to the Client during the photography session and the immediately surrounding events unless a direct course by the photographer has coursed the injury.
